I would answer that since they released their version publicly, it's also covered by the GPL. In some sense, the custom theme is a modification of the original theme, no?
It definitely is! But keep in mind, that their company logo will be part of the custom theme. I don't think that a company wants to put its logo under the GPL just because of a PMA theme. This is why I asked if we really want them to release their theme under the GPL.
I think that we should inform them of this. However I don't think we should merge their custom theme in our SVN or offer it for download. They would have the responsibility of giving access to the source code.
